Criminal Summary Convictions

If you are charged with a criminal offence or wanted by the Police for any criminal offence,

You must know , you have Charter rights.

  • Life, liberty and security of person – section 7
  • Search or seizure – section 8
  • Detention or imprisonment – section 9
  • Arrest or detention – section 10
  • Proceedings in criminal and penal matters – section 11
  • Treatment or punishment – section 12
  • Self-crimination – section 13
  • Interpreter – section 14

When you are charged, most of the charges are hybrid, an election to proceed Summarily or by indictment will be elected by the prosecution. The crown must prove all the elements of the charge that is laid against you, or the Court will dismiss those charges.

Please be aware that if you were convicted of any Summary conviction in Canada, the crown can ask Jail time up to 2 years less a day, and this can limit your entire future.
